We have an opening for an Assistant General Counsel in the Lawrence Livermore National Laboratory (LLNL) Office of General Counsel. The successful applicant will provide legal advice to Laboratory management and staff regarding construction contracting, dispute resolution, project management and environmental law issues pertaining the operation of a Department of Energy (DOE) national laboratory with an annual budget in excess of $2 Billion.
This position will be filled at either the D01.2 or D01.3 level depending on your qualifications. Additional job responsibilities (outlined below) will be assigned if the candidate is selected at the higher level.
Research case law, statutes and regulations, and draft legal guidance on routine matters related to construction and environment, worker safety and health (ES&H).
Draft, review, and provide legal advice regarding the preparation of construction-related documents, including contracts, specifications, modifications, etc.; related environmental studies and permit applications; and other similar documents related to construction and site operations.
Negotiate, or assist in negotiating, construction contracts and resolution of construction disputes, audit findings, and notices of violation issued by state or federal permitting authorities.
Draft, or provide assistance to more senior attorneys in drafting, internal policies and procedures relating to construction contracting, dispute resolution and environmental compliance as well corrective action plans resulting from audit findings and/or notices of violation issued by state or federal permitting authorities.
Manage, or support more senior attorneys in managing, routine litigation, arbitration, or mediation of disputes related to construction, environmental matters or other matters arising out of Laboratory operations (LLNL generally retains outside counsel for litigation matters).
Interact collaboratively with peers, Laboratory organizations and outside counsel.
Assist more experienced counsel in complex or sensitive transactional, litigation, and regulatory matters as requested, and p erform other duties as assigned.

In Addition at the D01.3 Level
Advise senior managers on sensitive matters of policy, sponsor engagement and risk management and assume leadership role in working with management, peers and other professional staff on multi-disciplinary teams in order to address legal or business matters that are diverse and multi-faceted in scope that may potentially have a significant financial or reputational impact on Laboratory programs or operations.
Analyze and interpret applicable federal and state statutes, regulations and contracts, and draft legal guidance on complex construction and ES&H issues.
With guidance from the General Counsel, represent and defend the Laboratory in complex legal matters related to construction and ES&H, to include assisting outside counsel in litigation matters, providing legal advice to management in developing Laboratory policy with and planning legal strategies for assigned caseloads and solving complex problems with potential institutional significance.
Juris doctorate from an ABA accredited law school, and either admitted to practice in California or eligible for a limited practice license as registered in-house counsel.
Ten or more years of experience actively practicing law in positions with progressively greater responsibility and involving matters of greater complexity and/or significance over time.
Broad knowledge of, and practical experience with, construction law, federal procurement law and federal and state environmental law, ideally in both the counseling and dispute resolution (including litigation) contexts.
Advanced analytical, writing, and presentation skills.
Experience leading and contributing to multi-disciplinary teams.
Demonstrated ability to collaborate with other attorneys and non-attorney professionals to work as a team in accomplishing goals and solving problems collectively.
In Addition at the D01.3 Level
Significant experience applying independent judgment in advising senior managers about legal and reputational risk and tradeoffs between and among possible courses of action.
Significant experience drafting and negotiating complex contractual agreements, including negotiating settlements, drafting formal and informal legal guidance, and drafting other policy related documents.
Experience developing best practices for owner-oriented construction templates, dispute resolution processes and counsel selection based upon experience resolving construction contract disputes.
Comprehensive knowledge and significant experience practicing general business law, with an emphasis in construction transactions and related environmental issues.
Demonstrated success in supporting multidisciplinary teams tasked with solving complex problems/disputes in an environment implicating the interests of multiple stakeholders.
Expert-level knowledge of the Federal Acquisition Regulation and federal and commercial construction contracting forms and disciplines such as project management.
Broad knowledge of, and experience applying, state and federal environmental laws pertaining to land use, waste disposal, air and water pollution and expert knowledge in one or more of the following: National Environmental Policy Act (NEPA); the California Environmental Quality Act (CEQA); the Resource Conservation and Recovery Act (RCRA); or Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).
Prior experience as a senior attorney assigned to support litigation, construction, environmental compliance or procurement for: (1) a U.S. government contractor; (2) a federal, state or local government entity, including military service; or (3) a private law firm practicing law in any or all of the referenced areas.
Familiarity with corporate insurance matters including risk management and bonding in construction contracts.
Pre-Employment Drug Test: External applicant(s) selected for this position will be required to pass a post-offer, pre-employment drug test.
Security Clearance: This position requires a Department of Energy (DOE) Q-level clearance.
If you are selected, we will initiate a Federal background investigation to determine if you meet eligibility requirements for access to classified information or matter. In addition, all L or Q cleared employees are subject to random drug testing. Q-level clearance requires U.S. citizenship. If you hold multiple citizenships (U.S. and another country), you may be required to renounce your non-U.S. citizenship before a DOE L or Q clearance will be processed/granted.
Note: This is a Career Indefinite position. Lab employees and external candidates may be considered for this position.
