We are currently seeking an outstanding Vice President of Litigation and Risk Management at our new Global Headquarters in Dallas, Texas., DJO Global is a leading global developer, manufacturer and distributor of high-quality medical devices that provide solutions for musculoskeletal health, vascular health and pain management. Our products address the continuum of patient care from injury prevention to rehabilitation after surgery, injury or from degenerative disease, enabling people to regain or maintain their natural motion. Our products are used by orthopedic specialists, spine surgeons, primary care physicians, pain management specialists, physical therapists, podiatrists, chiropractors, athletic trainers and other healthcare professionals. In addition, many of our medical devices and related accessories are used by athletes and patients for injury prevention and at-home physical therapy treatment. Product lines include rigid and soft orthopedic bracing, hot and cold therapy, bone growth stimulators, vascular therapy systems and compression garments, therapeutic shoes and inserts, electrical stimulators used for pain management and physical therapy products. Our surgical division offers a comprehensive suite of reconstructive joint products for the hip, knee and shoulder. Our products are marketed under a portfolio of brands including Aircast®, Chattanooga, CMF , Compex®, DonJoy®, ProCare®, Exos , Dr. Comfort®, DonJoy Performance® and DJO® Surgical. The DJO Vice President of Litigation and Risk Management will report to DJO's General Counsel, and will actively manage complex litigation matters across the U.S. and international markets, with a focus on product liability, commercial and non-compete litigation. The position will also focus on reducing risks throughout the business units, and developing processes and procedures to appropriately manage risk. DJO is looking for a dynamic and engaging leader, who has a collaborative and direct style., * Lead responsibility for a diverse range of litigation and pre-litigation disputes, including managing litigation in the state and federal court systems as well as domestic and international arbitrations, and managing subpoenas and other information requests and inquiries from third parties, including medical records requests. * Lead responsibility for government investigations, subpoenas and other government related matters. * Attend trials, mediations, arbitrations and depositions, where appropriate. * Advise the General Counsel and company management on strategy and resolution of cases and general risk management. * Drives strategy, execution, and management of outside counsel on litigation and related matters, including collaborating with outside counsel to manage all aspects of outside counsel relationships, including: staffing, litigation strategy, budgets, alternative fee arrangements, discovery and motion practice. * Collaborates with the General Counsel on periodic reporting on litigation results, budgets, forecasts, exposure analysis and litigation strategies, as well as evaluating litigation strategies, expenses and reserves with the company's independent auditors, risk managers and business unit leaders. * Lead responsibility for management of internal investigations. * Collaborates as risk manager and relationship point of contact with insurance carriers to manage SIR and deductible exhaustion as well as appropriate disbursement of funds from the policies. * Provides guidance to Marketing, Regulatory and Quality teams on appropriate messaging in written materials generated by the teams. * Provides advice and counsel to the businesses related to non-competes and other competitive hiring issues. * Education: Juris Doctor (J.D.) from an accredited law school * Licenses: Member in good standing of a State Bar Experience: * Attorney with 10+ years of experience in an in-house legal department and/or a major law firm handling complex litigation, including product liability, commercial, and employment disputes. At least 3 years of in-house counsel experience, managing attorneys and paralegals is preferred. Experience handling medical device product liability and commercial matters is a plus. * Demonstrated record for success strategizing, handling and managing complex product liability and commercial disputes to successful resolution. * Experience negotiating pre-litigation matters to successful resolution. * Experience with and knowledge of the medical device industry, including familiarity with HIPAA, FCA, FCPA, FDA and FTC rules and regulations. * Experience in managing a litigation team, including litigation paralegals.
